Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the title you are purchasing and might not reveal developments next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your local council covering Bishop Monkton. Usually, you can search most planning applications planning pages by postcode or by map search).

Do you recommend that both of us obtain a Environmental enquiry on the property that we are buying in Bishop Monkton? Yes we including this in our quote. We would always recommend an environmental check on the site you intend to purchase which is available from a number of search providers including Landmark. The environmental enquiry results provide details of present and past environmental risks together with a statement from an environmental consultant confirming whether or not the site, based upon the information revealed by the search, is likely to be classified contaminated land by the council.

Apart from showing that the property in Bishop Monkton is connected to the mains water supply and mains drainage what other results does a a CON29 DW search include? A drainage search verifies to a new buyer that the land parcel they are acquiring does not need a “build over consent” because the previous owner has constructed an extension close to a public drain. It also shows a raft of other details such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond. Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest practices for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you have everything you are responsible for all expenses needed to sustain the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Bishop Monkton some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the maintenance of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Bishop Monkton

Are you able to handle a mortgage with Monmouthshire Building Society in Bishop Monkton? Yes we are on the mortgage Panel for this lender.

Are you able to oversee Lifetime ISAs? Yes we deal with Lifetime ISAs in Bishop Monkton.

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying £300,000 or lower for a residential property will pay no Stamp Duty Land Tax. If you are paying between three hundred thousand pounds and half a million pounds will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over five hundred thousand pounds there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a leasehold what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional expenses can we anticipate? We cannot give you all the expenses up front in our quote. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing assignment packs often in a questionnaire called LPE1. The charge for this varies from company to company often it is approximately £200 but is can be more in unusual cases. Second, the lease usually contains a provision for the outgoing to pay a payment to the freeholder based on a percentage of the sale price which is often around 1-2% although other formula may be used. The lease will need to be checked carefully.
