Do I need to get a Enquiries of the local authority search if I’m a cash buyer? Cash buyers do have a choice on what they order when they are purchasing home and do not necessarily have to conduct a search. Many such clients think they know what a local search LLC1 will reveal and may know about the Bishops Frome or surrounding area however most conveyancing solicitors will still counsel for one. One of the main reasons is that the Official Local Authority search is the only place to reveal liabilities to the local council and this is more commonly the case with .

Why do we need environmental investigations in Bishops Frome? Statutory legislation have resulted in a remediation system for contaminated areas. The basic position is that the polluter should clean up however where that party is missing (for example because the work was done some time ago or the company has gone into bankruptcy the liability for clean-up costs passes to the present owner (who could be you). Even if you are purchasing an flat in Bishops Frome you may find that you are liable for the cost of any remediation through the maintenance charge provisions of the lease.

General Conveyancing Tips

Remember there are often one or more linked transactions involved in the “chain” and the interdependence of these sales means that everyone moves at the pace of the slowest transaction.

Always check what you are acquiring? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common mistakes a customer makes is not checking the plan properly. It is a good idea to go to the site to check that what is shown on the plan agrees with what you think you’re buying on site. All too often consumers mistakenly think that a piece of land at the side or rear of the land parcel is theirs, only to find out that the legal title to the house doesn’t include this site. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you own everything you are responsible for all expenses required to maintain the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including Bishops Frome some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the maintenance of the building in which the leasehold property is located and possibly also building insurance.

No because like all modern firms of lawyers we depend on technology to assist us in our work to ensure that matters are dealt with speedily. Your proximity to our office is not significant. What is a first time buyer? The meaning of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the the Government is an individual who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their main home. If you select “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

What SDLT if I am buying a second home in Bishops Frome? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over £40,000. If you select “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional expenses can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a flat in a retirement development what additional costs can we anticipate? We cannot give you all the expenses up front in our estimate. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing information often in a questionnaire called LPE1. The charge for this varies from organisation to organisation usually it is around £300 but is can be higher in extreme cases. Second, the lease could contains a provision for the selling to pay a payment to the landlord based on a % of the market value which is sometimes around 1-2% although other formula may be used. The lease will need to be checked carefully.

About Bishops Frome.

Bishop’s Frome (or Bishops Frome) is a village and civil parish in eastern Herefordshire, England. The village is 11 miles (18 km) north-east of the city and county town of Hereford, 8 miles (13 km) west of Malvern and 4 miles (6 km) south of Bromyard.

The River Frome flows north to south through the parish and at the eastern edge of the village. Local agriculture includes the growing of hops and cider apples. Within the parish is a cider making company and a wine making business. Bishop’s Frome gives its name to the Bishop’s Frome Limestone which outcrops locally. Parish population at the 2011 census was 834.[citation needed] Although the parish is in Herefordshire, its mail is handled in Worcester and its outward postcode is WR6.

St Mary’s parish church at the south of the village is approached through a lychgate. The church contains a font over 700 years old, and a memorial depicting the carved figure of a knight in armour, sword in hand and a lion at his feet.
