Searches on my Conveyancing Quote

How long do Local Authority search searches take? The ETA for a Enquiries of the local authority search can vary significantly, from 24 hours to six weeks! Although we order all our Local Authority searches via a website some searches are still processed managed manually by the council. Also the search wait time can be affected by seasonal demand levels and local council staffing levels.

When we get an Environmental enquiry on the property mentioned on the conveyancing quote for the property in Bishops Tachbrook what will it reveal? The search provides data of present and past contamination risks together with a assessment from an environmental expert confirming whether or not the land would be officially names as contaminated land by the local council. It may also reveal other information such as whether the property is within a flood risk area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and high radon area.

Why is a a CON29 DW search salient if you want to extent or alter the property in Bishops Tachbrook? One of the salient results shows the location of any public sewer on the property you are purchasing. This is worth knowing because if you want to build close to a public drain you might need a ‘Build-over Agreement’ with the water authority. This may restrict what you want to build and/or make the works more expensive.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer timeframe if you are trading selling down and have a lot of items to clear. You can accelerate the process if it is your first purchase. You may be able to exchange and complete on the same day. However your choice depend on what  others in the chain will consent to.

Always check what you are acquiring? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest errors a purchaser makes is not checking the plan properly. It is a good idea to go to the land parcel to check that what is shown on the plan agrees with what you think you’re looking at on site. All too often customers mistakenly think that a piece of land at the side or rear of the home is theirs, only to find out that the legal title to the house doesn’t include this site. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all outlays needed to repair the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Bishops Tachbrook some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the leasehold property is situated and possibly also building insurance.

FAQs in Bishops Tachbrook

Are you able to manage a mortgage with Coventry Building Society in Bishops Tachbrook? Yes we are on the mortgage Panel for this lender.

Are you able to conduct Lifetime ISAs? Yes we deal with Lifetime ISAs in Bishops Tachbrook.

What is a first time buyer? The characterisation of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the Revenue is an person who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their main house. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over forty thousand pounds. If you chose “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional fees can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

We are executors of our fathers estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our legal fees remain the same as our standard quote for this type of Seller.
