Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional queries that are not covered by the standard local authority search. These include: environmental searches in Bishopsbourne? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clear-up); water authority searches (which show any publicly owned sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

When we get a Environmental investigation on the property mentioned on the conveyancing quote for the property in Bishopsbourne what will it reveal? The search provides details of present and past contamination risks together with a report from an environmental expert confirming whether or not the land parcel could be classified contaminated land by the London Borough/council. It may also reveal other information such as whether the property is within a flood area area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and high radon zone.

Why is a drainage search key if you want to extent or alter the land in Bishopsbourne? One of the most useful details shows the location of any public sewer adjacent the site you are buying. This is worth knowing because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may stop what you want to build and/or make the footings cost more.

General Conveyancing Tips

How long does conveyancing take? For relatively simple sale or purchase, expect the conveyancing of your home to take possibly 2 to 3 months.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a quote what disbursements apply to your purchase and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £100 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on their fees disguised as ‘disbursements’. Make sure that any written quotes you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually kept by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the land for some time now although this was brought in at different times across the country. For the time in Bishopsbourne you should check with your solicitor. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Bishopsbourne

Are you able to manage a mortgage with Chorley Building Society in Bishopsbourne? Yes we are on the mortgage Panel for this lender.

Are you able to manage Lifetime ISAs? Yes we deal with Lifetime ISAs in Bishopsbourne.

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying three hundred thousand pounds or lower for a residential property will pay no Stamp Duty Land Tax. If you are paying between £300,000 and five hundred thousand pounds will pay SDLT at 5% on the amount of the purchase price in excess of £300k – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over £500,000 there is no relief for the first time buyer and the normal rates apply. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty Land Tax position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40,000. If you press “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a flat in a retirement development what additional costs can we anticipate? We cannot give you all the disbursements up front in our on line quote. There are going to be two potential costs. First, the costs charged by landlords and managing agents will vary for providing information packs often in a form called LPE1. The charge for this varies from organisation to organisation on average it is approximately £200-300 but is can be more in rare cases. Second, the lease usually contains a clause for the outgoing to pay a fee to the management company based on a % of the market value which is sometimes 1% although other formula may be used. The lease will need to be checked carefully.
