Searches on my Conveyancing Quote

How long do Enquiries of the local authority search searches take? The timescale for a local search LLC1 can vary significantly, from 24 hours to six weeks! Although we order all our Official Local Authority searches through our search provider’s website some searches are still processed administered manually by the Local Authority. Also the search ETA can be affected by seasonal demand levels and council staffing levels.

Do you recommend that we order a Environmental investigation on the property that we are buying in Bisterne? Yes we including this in our quote. We would always recommend an environmental search on the land you intend to purchase which is available from a number of search companies including Homecheck. The environmental check results provide details of present and past environmental risks together with a report from an environmental expert confirming whether or not the area, based upon the information revealed by the search, is likely to be officially names as contaminated land by the London Borough/council.

What is a Drainage & Water Enquiry ? A Drainage & Water Enquiry confirms to a potential interested party that the home they are acquiring is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of Bisterne which are countryside as there may be a a private drainage system.

General Conveyancing Tips

How long does conveyancing take? For relatively simple sale or purchase, expect the conveyancing of your home to take approximately 2 to 3 months.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were traditionally paper documents – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually retained by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the deeds for some period now although this was brought in at different times across the country. For the time in Bisterne you should check with your conveyancer. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Bisterne

Are you on the panel of Buckinghamshire Building Society? Yes we act for all major lenders and many smaller lenders.

We see that you do not have an office in Bisterne? Is this a concern? No because like all modern firms we count on technology to assist us in our firm to ensure that matters are dealt with rapidly. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Bisterne).

What SDLT will I pay if I am a first time buyer? First time buyers paying £300,000 or lower for a residential property will pay no Stamp Duty . If you are paying between £300k and five hundred thousand pounds will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a maisonette what additional expenses can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a maisonette what additional fees can we anticipate? We cannot give you all the costs up front in our quote. The costs charged by landlords and managing agents will vary for providing replies often in a questionnaire called LPE1. The charge for this varies from organisation to organisation usually it is around £200-300 but is can be more in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the management or very small buildings such as a single house converted into 2 maisonettes.
