Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional queries that are not covered by the standard local authority search. These include: environmental checks in Black Callerton? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clean-up); water authority searches (which show any publicly owned sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

Why do we need environmental enquiries in Black Callerton? Statutory laws have resulted in a clean-up scheme for contaminated areas. The basic position is that the polluter should pay however where that party is missing (for example because the work was done some time ago or the company has gone into liquidation the liability for remediation costs passes to the existing owner (who could be you). Even if you are purchasing an flat in Black Callerton you may find that you are liable for the cost of any clean-up through the maintenance charge provisions of the lease.

What is a a CON29 DW search ? A water authority search confirms to a potential owner that the land parcel they are acquiring is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of Black Callerton which are countryside as there may be a a private drainage system.

General Conveyancing Tips

How long does conveyancing take? For relatively average sale or purchase, expect the conveyancing of your home to take about 2 to 3 months.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when checking a estimate what disbursements apply to your sale and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £75 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on their legal fees disguised as ‘disbursements’. Make sure that any quotes you obtain contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually stored by your mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the property for some time now although this was brought in at different times across the country. For the time period in Black Callerton you should check with your conveyancer. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in Black Callerton

Are you on the panel of Tipton & Coseley Building Society? Yes we act for all major lenders and many smaller lenders.

Are you able to deal with Lifetime ISAs? Yes we deal with Lifetime ISAs in Black Callerton.

What is a first time buyer? The meaning of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the Taxman is an person who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their main home. If you select “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new property before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main house within three years.

If we are buying a flat what additional payments can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

We are executors of our fathers estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our legal costs remain the same as our standard quote for this type of Seller.

About Black Callerton.

Black Callerton is a hamlet and former civil parish about 5 miles from Newcastle upon Tyne, now in the parish of Woolsington, in the Newcastle upon Tyne district, in the county of Tyne and Wear, England. In 1951 the parish had a population of 365.

The name “Callerton” means ‘Calves’ hill, the “Black” part distinguishes it from High and Little Callerton. Black Callerton is possibly a shrunken medieval village, although there is no indications on the ground. Black Callerton was formerly a township in the parish of Newburn, from 1866 Black Callerton was a civil parish in its own right until it was abolished and merged with Woolsington on 1 April 1955. In 1974 it became part of Tyne and Wear, having previously been part of Northumberland.
