Searches on my Conveyancing Quote

How long do local search LLC1 searches take? The wait time for a Official Local Authority search can vary significantly, from 24 hours to six weeks! Although we order all our Official Local Authority searches via a website some searches are still processed processed manually by the council. Also the search timescale can be affected by seasonal demand levels and council staffing levels.

When we obtain an Environmental check on the property mentioned on the conveyancing quote for the property in Blackburn what will it reveal? The search provides replies of present and past pollution risks together with a report from an environmental consultant confirming whether or not the property is likely to be designated contaminated land by the London Borough/council. It may also reveal other information such as whether the property is within a flood risk area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and high radon area.

Apart from showing that the site in Blackburn is connected to the mains water supply and mains drainage what other data does a a CON29 DW search show? A water authority search illustrates to a future interested party that the land parcel they are interested in does not need a “build over consent” because the seller has constructed an extension adjacent a public drain. It also shows a raft of other data such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer time if you are trading selling down and have a lot of items to clear. You can speed the process if it is your first purchase. You may be able to exchange and complete simultaneously. However your choice depend on what  others in the chain will agree to.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest solicitors for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all costs necessary to upkeep the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Blackburn some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the maintenance of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Blackburn

Are you able to oversee a mortgage with Tipton & Coseley Building Society in Blackburn? Yes we are on the mortgage Panel for this lender.

We are aware that you do not have an office in Blackburn? Is this a issue? No because like all modern practices we depend on technology to assist us in our office to ensure that matters are dealt with expeditiously. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Blackburn).

If you are a first time buyer what additional fees can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your conveyancer are required to make certain steps to make sure release of those ISAs including any bonus. If you complete the online quote you will see there is an yes no box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty which will be nil up to £300,000. If you press “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a leasehold what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a maisonette what additional payments can we anticipate? We cannot give you all the figures up front in our quote. The costs charged by freeholder and management companies will vary for providing responses often in a questionnaire called LPE1. The charge for this varies from company to company on average it is around £2500 but is can be higher in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the maintenance or very small buildings such as a single house converted into a couple leaseholds.

About Blackburn.

Blackburn is a large industrial town located in Lancashire, England, north of the West Pennine Moors on the southern edge of the Ribble Valley, 8 miles (13 km) east of Preston and 20.9 miles (34 km) NNW of Manchester. Blackburn is bounded to the south by Darwen, with which it forms the unitary authority of Blackburn with Darwen; Blackburn is its administrative centre.

At the 2001 census, Blackburn had a population of 105,085, whilst the wider borough of Blackburn with Darwen had a population of 148,850. Blackburn had a population of 117,963 in 2011.

A former mill town, textiles have been produced in Blackburn since the middle of the 13th century, when wool was woven in people’s houses in the domestic system. Flemish weavers who settled in the area in the 14th century helped to develop the woollen cottage industry. The most rapid period of growth and development in Blackburn’s history coincided with the industrialisation and expansion of textile manufacturing.

Blackburn’s textile sector fell into decline from the mid-20th century and subsequently faced similar challenges to other post-industrial northern towns, including deindustrialisation, economic deprivation and housing problems. The town has experienced very high levels of immigration, with people of ethnic backgrounds other than white British making up 30.8% of the population. Blackburn has had significant investment and redevelopment since 1958 through government funding and the European Regional Development Fund.
