Searches on my Conveyancing Quote

What is included in a local authority search covering Blackhall Colliery? There are two parts to a local authority search – LLC1 and CON29. The Local Land Charge Register search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the title, whether the title is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the land is in need of an improvement or renovation grant. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

I heard that the Land Charges Enquiries in Blackhall Colliery will show if the land is contaminated. Is that right? That is not right. Whilst it is correct that Local Authorities are now in the process of identifying contaminated sites and recording these areas on registers – this is a process which will take a an uncertain amount of time to end. Needless to say any areas named within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any Con29 Searches are likely to be incomplete.

What is a a CON29DW ? A Drainage & Water Enquiry confirms to a potential interested party that the land they are acquiring is connected to the mains water supply and mains drainage. This is particularly significant in parts of Blackhall Colliery which are not built up as there may be a a private drainage system.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer period if you are trading selling down and have a lot of items to get rid of. You can prompt the process if it is your first buy. You may be able to exchange and complete together. However your instructions depend on what  others in the chain will agree to.

Always check what you are acquiring? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest mistakes a consumer makes is not checking the plan properly. It is a good idea to go to the home to check that what is shown on the plan agrees with what you think you’re looking at on site. All too often consumers mistakenly think that a piece of land at the side or rear of the land parcel is theirs, only to later discover that the legal title to the house doesn’t include this bit of garden. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you own everything you are responsible for all costs required to uphold the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Blackhall Colliery some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the flat is situated and possibly also building insurance.

FAQs in Blackhall Colliery

Are you able to conduct a mortgage with HSBC Bank plc in Blackhall Colliery? Yes we are on the mortgage Panel for this lender.

We note that you do not have an office in Blackhall Colliery? Is this a issue? No because like all modern lawyers we rely on technology to assist us in our firm to ensure that matters are dealt with swiftly. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes Blackhall Colliery).

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the Revenue is an person who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their main home. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new property before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main property within 36 months.

If we are buying a leasehold what additional expenses can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional expenses can we anticipate? We cannot give you all the disbursements up front in our on line quote. There are going to be two potential costs. First, the costs charged by freeholder and management companies will vary for providing information often in a pro forma response called LPE1. The charge for this varies from organisation to organisation on average it is around £200-300 but is can be more in extreme cases. Second, the lease could contains a provision for the assignor to pay a fee to the freeholder based on a percentage of the market value which is often around 1-2% although other formula may be used. The lease will need to be checked carefully.

About Blackhall Colliery.

Blackhall Colliery is a village on the North Sea coast of County Durham, in England. It is situated on the A1086 between Horden and Hartlepool. To the south of the Blackhall Colliery’s Catholic church is Blackhall Rocks.

Built around the once extensive mining industry, Blackhall’s colliery closed in 1981. Daniel Hall was one of the founding fathers of the colliery and invested heavily in the establishment of the mining infrastructure in the area. It is believed but unconfirmed that the name Black-Hall was established as a result of Daniels alias ‘Black’ due to his association with the mining of coal and his surname Hall. In 1991 a local campaign to erect a statue of Mr Hall was unsuccessful due to a lack of available funding from the local Authority. There is now an industrial estate built over part of the old colliery buildings, the colliery itself was pulled down in the 1980s. Blackhall Colliery is on the edge of Castle Eden Dene, and Castle Eden Dene Mouth.

Over the past couple of decades, there have been many changes. Following the closure of the colliery, the once busy village has economically gone downhill. As time has passed since the closure, other industries have now begun to emerge to once again create employment in the region.[citation needed]

With both Blackhall Colliery and Blackhall Rocks being on the main road to Peterlee and Hartlepool. This has meant that these villages have become commuter villages, supplying workers for the now busy and expanding call centres in the nearby towns of Hartlepool and Peterlee.[citation needed]
