Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional reports that are not covered by the standard local authority search. These include: environmental checks in Blackley? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clean-up); water authority searches (which show any mains sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

I am advised that the Land Charges Searches in Blackley will show if the land is contaminated. Is that correct? Not really. Whilst it is correct that councils are now in the process of identifying contaminated property and recording these land on registers – this is a process which will take a unknown period of time to end. Needless to say any areas entered within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any Land Charges Enquiries are likely to be incomplete.

Why is a water authority search salient if you want to extent or alter the property in Blackley? One of the vital details shows information of any public sewer close to the home you are acquiring. This is significant because if you want to build near a public drain you might need a ‘Build-over Agreement’ with the water authority. This may stop what you want to build and/or make the works more expensive.

General Conveyancing Tips

Remember there are often a few connect purchases involved in the “chain” and the interdependence of these sales means that everyone moves at the pace of the slowest sale or purchase.

Always check what you are acquiring? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest mistakes a consumer makes is not checking the plan properly. It is a good idea to visit the home to check that what is shown on the plan agrees with what you think you’re looking at on site. All too often clients mistakenly think that a piece of land at the side or rear of the site is theirs, only to find out that the legal title to the property doesn’t include this land. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all outlays required to upkeep the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including Blackley some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the leasehold property is located and possibly also building insurance.

FAQs in Blackley

Are you on the panel of Newcastle Building Society? Yes we act for all major lenders and many smaller lenders.

Are you able to handle Lifetime ISAs? Yes we deal with Lifetime ISAs in Blackley.

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the Taxman is an individual who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their home. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty Land Tax position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over £40,000. If you press “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional costs can we anticipate? This is one tricky area where we cannot give you all the figures up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

I am the executor of my mother estate. Do you deal with sales by executors? Yes. As administrators of the Estate you can sell and our costs remain the same as our standard quote for this type of Seller.
