Searches on my Conveyancing Quote

What is included in a local authority search covering Bletchingdon? There are two parts to a local authority search – Local Land Charges search and Enquiries of the local authority. The second part of the search – CON29 – supplies information relating to public highways, proposals for new major roads, rail schemes or planning decisions relating to the land. The responses can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

I am advised that the local authority Search in Bletchingdon will show if the land is contaminated. Is that accurate? That is not right. Whilst it is correct that Local Authorities are now in the process of locating contaminated land parcels and recording these land parcels on registers – this is a process which will take a unknown period of time to deliver upon. Needless to say any areas included within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any local authority Search are likely to be incomplete.

What is a drainage search ? A drainage search confirms to a potential owner that the site they are buying is connected to the mains water supply and mains drainage. This is particularly significant in parts of Bletchingdon which are not built up as there may be a a private drainage system.

General Conveyancing Tips

How long does conveyancing take? For relatively simple sale or purchase, expect the conveyancing of your house to take on average eight and twelve weeks.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest practices for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you own everything you are responsible for all outlays needed to sustain the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including Bletchingdon some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the flat is situated and possibly also building insurance.

You will usually save on Stamp Duty Land Tax which will be nil up to three hundred thousand pounds. If you chose “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a leasehold what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

If we are selling a maisonette what additional costs can we anticipate? We cannot give you all the costs up front in our quote. The costs charged by landlords and managing agents will vary for providing information often in a questionnaire called LPE1. The charge for this varies from company to company mainly it is around £200 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into 2 maisonettes.
