Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional areas that are not covered by the standard local authority search. These include: environmental enquiries in BR1? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a remediation); water authority searches (which show any publicly owned sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

When we ask for an Environmental check on the property mentioned on the conveyancing quote for the property in BR1 what will it reveal? The search provides information of present and past contamination risks together with a certificate from an environmental consultant confirming whether or not the properties is likely to be classified contaminated land by the Local Authority. It may also reveal other information such as whether the property is within a flood area area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and in an area with high radon readings.

Why is a a CON29 DW search critical if you want to extent or alter the site in BR1? One of the main results shows the location of any public sewer within the land parcel you are purchasing. This is worth knowing because if you want to build within three metres of a public drain you might need a ‘Build-over Agreement’ with the water authority. This may limit what you want to build and/or make the design more expensive.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer period if you are trading selling down and have a lot of items to clear. You can quicken the process if it is your first purchase. You may be able to exchange and complete together. However your choice depend on what  others in the chain will consent to.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you own everything you are responsible for all costs necessary to maintain the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including BR1 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the maintenance of the building in which the flat is situated and possibly also building insurance.

These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

We have obtained probate for my mother estate. Do you deal with sales by administrators? Yes. As administrators of the Estate you can sell and our expenses remain the same as quoted for this type of Seller.
