What is a Local Authority Search and why is it needed in BR3? Whilst this is to a conveyancing solicitors and banks and building societies an important part of the home buying process to consumers the need for this may be somewhat of a mystery. However the search reveals relevant|applicable|appropriate|useful information for your matter. In some cases the information revealed can be used to change your the purchase price or and may even make you abort from the buying.

I am told that the Con29 Search in BR3 will show if the land is contaminated. Is that correct? Not really. Whilst it is correct that Local Authorities are now in the process of locating contaminated land and recording these land parcels on registers – this is a process which will take a number of years to finish. Needless to say any properties included within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any Con29 Searches are likely to be incomplete.

What is a drainage search ? A drainage search confirms to a future owner that the land parcel they are purchasing is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of BR3 which are countryside as there may be a a private drainage system.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer timeframe if you are trading buying down and have a lot of items to get rid of. You can speed the process if it is a first time buy. You may be able to exchange and complete together. However your instructions depend on what  others in the chain will agree to.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when obtaining a quote what disbursements apply to your purchase and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £75 cheaper than Firm A, but what about that unusual ‘disbursement’ of £140 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on their fees disguised as ‘disbursements’. Make sure that any estimates you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all costs necessary to sustain the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including BR3 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the care of the building in which the leasehold property is situated and possibly also building insurance.

What SDLT will I pay if I am a first time buyer? First time buyers paying £300,000 or less for a residential property will pay no SDLT. If you are paying between £300,000 and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of £300k – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over five hundred thousand pounds there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new residence before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main residence within three years.

If we are buying a maisonette what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

We are executors of our family estate. Do you deal with sales by executors? Yes. As administrators of the Estate you can sell and our expenses remain the same as our standard quote for this type of Seller.
