Searches on my Conveyancing Quote

What is included in a local authority search covering CR5? There are two parts to a local authority search – Local Land Charges search and Enquiries of the local authority. The Local Land Charges search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the house, whether the property is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the title is in need of an improvement or renovation grant. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

I am advised that the official local Search in CR5 will show if the land is contaminated. Is that correct? No. Whilst it is correct that Local Authorities are now in the process of locating polluted areas and recording these properties on registers – this is a process which will take a an uncertain amount of time to end. Needless to say any areas included within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any local authority Search are likely to be incomplete.

Why is a a CON29 DW search vital if you want to extent or alter the property in CR5? One of the basic details shows a plan of of any public sewer close to the home you are interested in. This is important because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may restrict what you want to build and/or make the build cost more.

General Conveyancing Tips

There is more often than not a mortgage loan to obtain and it should be noted that a solicitor cannot rely on a “nod and a wink” by mortgage broker or anyone else. He must have sight of your formal written mortgage offer in order that he may (i) be sure that you are getting the amount you need and verify that you can comply with any special conditions imposed in the mortgage terms.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancers to third parties such as search fees and Land Registry fees and stamp duty. Double check when checking a estimate what disbursements apply to your purchase and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on their fees disguised as ‘disbursements’. Make sure that any written quotes you obtain contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were traditionally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually retained by your mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the land for some period now although this was brought in at different times across the country. For the date in CR5 you should check with your lawyer. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

If you are a first time buyer what additional costs can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your lawyer are required to make certain procedures to make sure release of those funds including any bonus. If you complete the estimate you will see there is an option for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on SDLT which will be nil up to £300k. If you press “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional expenses can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a flat in a retirement development what additional expenses can we anticipate? We cannot give you all the costs up front in our estimate. There are going to be two potential costs. First, the costs charged by landlords and managing agents will vary for providing replies often in a form called LPE1. The charge for this varies from company to company mainly it is approximately £200-300 but is can be higher in unusual cases. Second, the lease usually contains a mechanism for the selling to pay a payment to the landlord based on a percentage of the market value which is mainly 1% although other formula may be used. The lease will need to be checked carefully.
