Do I need to get a Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they ask us to order when they are purchasing a house and do not necessarily have to conduct a search. Many such customers think they know what a Local Authority search will reveal and may know about the DA14 or surrounding area however most conveyancing lawyers will still counsel for one. One of the main reasons is that the Official Local Authority search is the only place to reveal indebtedness to the council and this is more commonly the case with probate properties.

Do we need environmental checks in DA14? Statutory laws have resulted in a remediation system for contaminated land parcels. The basic position is that the polluter should clear-up however where that party disappears (for example because the work was done some time ago or the company has gone into a winding up the liability for clear-up costs passes to the existing owner (who could be you). Even if you are purchasing an lease in DA14 you may find that you are liable for the cost of any remediation through the service charge provisions of the lease.

What is a water authority search ? A a CON29 DW search confirms to a new buyer that the land they are purchasing is connected to the mains water supply and mains drainage. This is particularly significant in parts of DA14 which are countryside as there may be a a private drainage system.

Remember there are commonly many linked purchases involved in the “chain” and the interdependence of these sales means that everyone moves at the pace of the slowest link in the chain.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms of lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you own everything you are responsible for all costs required to repair the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including DA14 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the leasehold property is situated and possibly also building insurance.

They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a maisonette what additional disbursements can we anticipate? We cannot give you all the figures up front in our estimate. The costs charged by freeholder and management companies will vary for providing assignment packs often in a pro forma response called LPE1. The charge for this varies from company to company often it is approximately £200 but is can be more in extreme cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the management or very small buildings such as a single house converted into two maisonettes.
