Searches on my Conveyancing Quote

Do I need to get a Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they get when they are purchasing a property and do not necessarily have to conduct a search. Many such clients think they know what a Local Authority search will reveal and may know about the DA8 or surrounding locale however most lawyers will still prescribe one. One of the main reasons is that the Enquiries of the local authority search is the only place to reveal liabilities to the Local Authority and this is more commonly the case with probate properties.

I think that the Con29 Enquiries in DA8 will show if the land is contaminated. Is that correct? Not really. Whilst it is correct that councils are now in the process of locating contaminated areas and recording these sites on registers – this is a process which will take a many years to end. Needless to say any land parcels included within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any local Searches are likely to be incomplete.

Apart from showing that the land in DA8 is connected to the mains water supply and mains drainage what other data does a drainage search include? A Drainage & Water Enquiry verifies to a potential owner that the land they are acquiring does not need a “build over consent” because the vendor has constructed an extension close to a public drain. It also shows a raft of other data such as water quality and historical evidence of internal sewer flooding.

How long does conveyancing take? For relatively straightforward sale or purchase, expect the conveyancing of your property to take around eight and twelve weeks.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you have everything you are responsible for all bills incurred to uphold the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including DA8 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the leasehold property is located and possibly also building insurance.

If we are buying a maisonette what additional fees can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a maisonette what additional expenses can we anticipate? We cannot give you all the figures up front in our estimate. The costs charged by landlords and management companies will vary for providing responses often in a questionnaire called LPE1. The charge for this varies from company to company usually it is around £200-300 but is can be more in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the management or very small buildings such as a single house converted into 2 flats.
