Searches on my Conveyancing Quote

What is included in a local authority search covering E10? There are two parts to a local authority search – LLC1 and CON29. The Local Land Charges search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the property, whether the title is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the land is situated in a smoke control zone. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

I am advised that the official local Enquiries in E10 will show if the land is contaminated. Is that accurate? That is not correct. Whilst it is correct that Local Authorities are now in the process of identifying contaminated sites and recording these land on registers – this is a process which will take a many years to deliver upon. Needless to say any property listed within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any local authority Search are likely to be incomplete.

Apart from showing that the land in E10 is connected to the mains water supply and mains drainage what other replies does a Drainage & Water Enquiry contain? A a CON29DW verifies to a new purchaser that the house they are acquiring does not need a “build over consent” because the seller has constructed an addition to the house adjacent a public drain. It also shows a raft of other data such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

There is always likely to be a mortgage offer to apply for and it should be noted that a conveyancer cannot rely on a quick email by mortgage broker or anyone else. The conveyancing solicitor will need to have sight of your formal written offer of mortgage in order that they may (i) be able to check that you are getting the amount you need and be able to check that you can comply with any offer conditions imposed in the mortgage offer.

Always check what you are purchasing? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest mistakes a client makes is not checking the plan properly. It is a best to visit the land parcel to check that what is shown on the plan agrees with what you think you’re looking at on site. All too often customers mistakenly think that a piece of land at the side or rear of the land parcel is theirs,only to later discover that the legal title to the land parcel doesn’t include this space. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you own everything you are responsible for all bills required to sustain the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including E10 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the maintenance of the building in which the flat is situated and possibly also building insurance.

This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a maisonette in a retirement development what additional expenses can we anticipate? We cannot give you all the expenses up front in our quote. There are going to be two potential costs. First, the costs charged by landlords and managing agents will vary for providing responses often in a questionnaire called LPE1. The charge for this varies from organisation to organisation mainly it is approximately £250 but is can be higher in rare cases. Second, the lease often contains a agreement for the selling to pay a payment to the management company based on a percentage of the market value which is mainly 1% although other formula may be used. The lease will need to be checked carefully.
