Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional reports that are not covered by the standard local authority search. These include: environmental checks in E11? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clear-up); water authority searches (which show any mains sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

Do you recommend that we get an Environmental investigation on the property that we are buying in E11? Yes we including this in our quote. We would always recommend an environmental check on the land you intend to purchase which is available from a number of search companies including Groundsure. The environmental enquiry results provide details of present and past environmental risks together with a assessment from an environmental expert confirming whether or not the land, based upon the information revealed by the search, would be designated contaminated land by the local council.

Why is a drainage search salient if you want to extent or alter the land parcel in E11? One of the main results shows a map of any public sewer nearby the house you are interested in. General Conveyancing Tips

How long does conveyancing take? For relatively straightforward sale or purchase, expect the conveyancing of your house to take possibly eight and twelve weeks.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a estimate what disbursements apply to your sale and purchase and check any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on fees disguised as ‘disbursements’. Make sure that any quotes you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all costs incurred to repair the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including E11 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the flat is situated and possibly also building insurance.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a leasehold what additional costs can we anticipate? This is one tricky area where we cannot give you all the figures up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

I have obtained probate for our mother estate. Do you deal with sales by executors? Yes. As executors of the Estate you can sell and our fees remain the same as quoted for this type of Seller.
