Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the title you are purchasing and might not show developments next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your borough council covering E14. Usually, you can search most planning applications on line by postcode or by map search).

I think that the official local Searches in E14 will show if the land is contaminated. Is that correct? That is not right. Whilst it is correct that councils are now in the process of finding polluted property and recording these areas on registers – this is a process which will take a unknown period of time to end. Needless to say any land entered within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any Con29 Search are likely to be incomplete.

What is a a CON29 DW search ? A drainage search confirms to a potential interested party that the land parcel they are purchasing is connected to the mains water supply and mains drainage. This is particularly significant in parts of E14 which are country as there may be a a private drainage system.

General Conveyancing Tips

Remember there are often one or more linked transactions involved in the “chain” and the interdependence of these purchases means that everyone moves at the pace of the slowest sale or purchase.

Always check what you are acquiring? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common mistakes a buyer makes is not checking the plan properly. It is a best to go to the land parcel to check that what is shown on the plan agrees with what you think you’re purchasing on site. All too often purchasers mistakenly think that a piece of land at the side or rear of the land parcel is theirs,only to later discover that the legal title to the land parcel doesn’t include this land. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you own everything you are responsible for all costs incurred to upkeep the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including E14 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the leasehold property is situated and possibly also building insurance.

What is a first time buyer? The description of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the Revenue is an individual who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their main house. If you chose “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty Land Tax position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over £40k. If you select “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional expenses can we anticipate? This is one tricky area where we cannot give you all the costs up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional payments can we anticipate? We cannot give you all the disbursements up front in our quote. There are going to be two potential costs. First, the costs charged by freeholder and managing agents will vary for providing responses often in a form called LPE1. The charge for this varies from company to company on average it is approximately £200-300 but is can be higher in extreme cases. Second, the lease often contains a provision for the selling to pay a fee to the management company based on a percentage of the market value which is mainly around 1-2% although other formula may be used. The lease will need to be checked carefully.
