What is included in a local authority search covering E17? There are two parts to a local authority search – LLC1 and Enquiries of the local authority. The second part of the search – CON29 – supplies information relating to whether the roadway abutting the property is maintained at public expense, proposals for new major roads, railway schemes or planning approvals relating to the title. The responses can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

I believe that the official local Enquiries in E17 will show if the land is contaminated. Is that correct? That is not correct. Whilst it is correct that councils are now in the process of locating polluted land and recording these areas on registers – this is a process which will take a number of years to accomplish. Needless to say any areas named within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Searches are likely to be incomplete.

What is a drainage search ? A a CON29 DW search confirms to a future purchaser that the home they are buying is connected to the mains water supply and mains drainage. This is particularly important in parts of E17 which are country as there may be a a private drainage system.

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond.Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you own everything you are responsible for all outlays needed to uphold the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including E17 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the flat is situated and possibly also building insurance.

These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a maisonette what additional expenses can we anticipate? We cannot give you all the expenses up front in our on line quote. The costs charged by landlords and management companies will vary for providing information packs often in a questionnaire called LPE1. The charge for this varies from company to company mainly it is approximately £200-300 but is can be higher in extreme cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the management or very small buildings such as a single house converted into 2 leaseholds.
