Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional queries that are not covered by the standard local authority search. These include: environmental checks in E18? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clear-up); water authority searches (which show any public sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

Do you recommend that I ask for a Environmental enquiry on the property that we are buying in E18? Yes we including this in our quote. We would always recommend an environmental search on the area you intend to purchase which is available from a number of search providers including Homecheck. The environmental enquiry results provide details of present and past environmental risks together with a certificate from an environmental consultant confirming whether or not the properties, based upon the information revealed by the search, is likely to be designated contaminated land by the Local Authority.

Why is a water authority search important if you want to extent or alter the house in E18? One of the important results shows a plan of of any public sewer on the house you are purchasing. This is significant because if you want to build within three metres of a public drain you might need a ‘Build-over Agreement’ with the water authority. This may limit what you want to build and/or make the design cost more.

General Conveyancing Tips

Remember there are commonly several linked sales involved in the “chain” and the interdependence of these transactions means that everyone moves at the pace of the slowest link in the chain.

Always check what you are buying? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest mistakes a client makes is not checking the plan properly. It is a good idea to go to the land to check that what is shown on the plan agrees with what you think you’re buying on site. All too often clients mistakenly think that a piece of land at the side or rear of the land parcel is theirs,only to later discover that the legal title to the property doesn’t include this land. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you have everything you are responsible for all costs needed to sustain the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including E18 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the flat is situated and possibly also building insurance.

If you are a first time buyer what additional payments can we anticipate? If you are using a Help to Buy ISA or Lifetime ISA your conveyancer are required to make certain actions to facilitate release of those ISAs including any bonus. If you complete the online quote you will see there is an yes no box for Help to Buy ISA or Lifetime ISA. Please chose yes if you have one. You will usually save on Stamp Duty which will be nil up to £300,000. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a flat what additional expenses can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a flat what additional expenses can we anticipate? We cannot give you all the expenses up front in our on line quote. The costs charged by freeholder and management companies will vary for providing information packs often in a pro forma response called LPE1. The charge for this varies from organisation to organisation often it is around £250 but is can be higher in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the maintenance or very small buildings such as a single house converted into 2 leaseholds.
