What is a Local Authority Search and why is it needed in E3? Whilst this is to a solicitors and mortgage lenders an indispensable piece of the home buying process to consumers the need for this may be somewhat of a mystery. However the search reveals relevant|applicable|appropriate|useful information for your matter. In rare cases the information revealed can be used to alter your the price or and may even make you abort from the matter.

I heard that the Land Charges Search in E3 will show if the land is contaminated. Is that correct? That is not right. Whilst it is correct that Local Authorities are now in the process of locating contaminated land parcels and recording these land parcels on registers – this is a process which will take a an uncertain amount of time to deliver upon. Needless to say any sites entered within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Enquiries are likely to be incomplete.

General Conveyancing Tips

There is often a mortgage to obtain and it should be noted that a lawyer cannot rely on a oral confirmation by mortgage broker or anyone else. The conveyancer must have sight of your final written mortgage offer in order that he may (i) be able to check that you are getting the loan you need and ensure that you can comply with any special conditions imposed in the offer of loan.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when obtaining a estimate what disbursements apply to your purchase and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £75 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on their legal fees disguised as ‘disbursements’. Make sure that any quotes you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all costs necessary to upkeep the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including E3 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the flat is situated and possibly also building insurance.
