Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the property you are purchasing and might not show land with planning consents next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your council covering E4. Usually, you can search most planning applications on line by postcode or by map search).

Do we need environmental checks in E4? Statutory laws have resulted in a remediation system for contaminated areas. The basic position is that the polluter should pay however where that party is missing (for example because the work was done some time ago or the company has gone into bankruptcy the liability for clean-up costs passes to the current owner (who could be you). Even if you are purchasing an leasehold in E4 you may find that you are liable for the cost of any clean-up through the service charge provisions of the lease.

Apart from showing that the site in E4 is connected to the mains water supply and mains drainage what other information does a a CON29 DW search contain? A a CON29DW verifies to a future owner that the home they are purchasing does not need a “build over consent” because the seller has constructed an alteration close to a public drain. It also shows a raft of other details such as water quality and historical evidence of internal sewer flooding.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

Would highly recommend Mouzzam at KER. Transaction went through very quickly and smoothly. He always responded quickly to any queries I had. I recommend this firm without any doubt. Mouzzam in particular has been extremely helpful throughout the purchase of our home and has been very easy to liaise with. They (Kenneth, Elliot and Rowe) offer a fantastic service and would definately use them again.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

There is always likely to be a mortgage to apply for and it should be noted that a conveyancer cannot rely on a informal confirmation by mortgage broker or anyone else. The lawyer will need to have sight of your formal written mortgage offer in order that he may (i) verify that you are getting the loan you need and verify that you can comply with any special conditions imposed in the offer of loan.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms of lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were traditionally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by a mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the deeds for some times now although this was brought in at different times across the country. For the time in E4 you should check with your lawyer. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in E4

Are you able to oversee a mortgage with Hinckley & Rugby Building Society in E4? Yes we are on the mortgage Panel for this lender.

We see that you do not have an office in E4? Is this a concern? No because like all modern firms we depend on technology to assist us in our practice to ensure that matters are dealt with expeditiously. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes E4.

What is a first time buyer? The definition of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the the Government is an person who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their home. If you chose “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a maisonette what additional payments can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a maisonette in a retirement development what additional expenses can we anticipate? We cannot give you all the disbursements up front in our on line quote. There are going to be two potential costs. First, the costs charged by landlords and managing agents will vary for providing responses often in a form called LPE1. The charge for this varies from company to company often it is approximately £200-300 but is can be higher in unusual cases. Second, the lease may contains a mechanism for the assigning to pay a fee to the management company based on a % of the market value which is sometimes 2% although other formula may be used. The lease will need to be checked carefully.
