Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the house you are purchasing and might not reveal developments next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your planning department covering E5. Usually, you can search most planning applications on the web by postcode or by map search).

Do you recommend that both of us get a Environmental search on the property that we are buying in E5? Yes we including this in our quote. We would always recommend an environmental check on the ground you intend to purchase which is available from a number of suppliers including Future Climate. The environmental enquiry results provide details of present and past environmental risks together with a report from an environmental consultant confirming whether or not the site, based upon the information revealed by the search, is likely to be officially names as contaminated land by the council.

What is a Drainage & Water Enquiry ? A drainage search confirms to a future interested party that the site they are purchasing is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of E5 which are not built up as there may be a a private drainage system.

General Conveyancing Tips

Remember there are invariably a few related sales involved in the “chain” and the interdependence of these purchases means that everyone moves at the pace of the slowest sale.

Always check what you are buying? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common mistakes a customer makes is not checking the plan properly. It is a best to go to the land parcel to check that what is shown on the plan agrees with what you think you’re purchasing on site. All too often clients mistakenly think that a piece of land at the side or rear of the property is theirs,only to find out that the legal title to the home doesn’t include this area. Always be satisfied that the title plan matches the physical position at the property.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually retained by your mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the land for some times now although this was brought in at different times across the country. For the time scale in E5 you should check with your conveyancer. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

Are you able to conduct Lifetime ISAs? Yes we deal with Lifetime ISAs in E5.

What SDLT will I pay if I am a first time buyer? First time buyers paying three hundred thousand pounds or less for a residential property will pay no Stamp Duty . If you are paying between £300,000 and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of £300k – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over £500,000 there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty Land Tax position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over forty thousand pounds. If you press “yes” to the “Buy to Let/Second Owner” toggle on the conveyancing quote the correct rate will calculate for you.

If we are buying a leasehold what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

We have obtained probate for our mother estate. Do you deal with sales by executors? Yes. As administrators of the Estate you can sell and our expenses remain the same as our standard quote for this type of Seller.
