How long do Enquiries of the local authority search searches take? The time for a Official Local Authority search can vary significantly, from 24 hours to six weeks! Although we order all our Local Authority searches electronically some searches are still processed administered manually by the council. Also the search ETA can be affected by seasonal demand levels and council staffing levels.

I believe that the local authority Enquiries in E6 will show if the land is contaminated. Is that accurate? Not really. Whilst it is correct that councils are now in the process of locating polluted land parcels and recording these areas on registers – this is a process which will take a an uncertain amount of time to end. Needless to say any property named within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Enquiries are likely to be incomplete.

What is a drainage search ? A a CON29 DW search confirms to a new buyer that the land they are buying is connected to the mains water supply and mains drainage. This is particularly significant in parts of E6 which are country as there may be a a private drainage system.

General Conveyancing Tips

There is more often than not mortgage finance to organise and it should be noted that a conveyancing solicitor cannot rely on a quick email by mortgage broker or anyone else. The Solicitor will need to have sight of your official written offer of mortgage in order that they may (i) be sure that you are getting the loan you need and ensure that you can comply with any lender’s conditions imposed in the mortgage terms.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a estimate what disbursements apply to your matter and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £100 cheaper than Firm A, but what about that unusual ‘disbursement’ of £195 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on their fees disguised as ‘disbursements’. Make sure that any written quotes you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually retained by your mortgage lender or solicitor. If these deeds are lost this can cause problems. Registration has been compulsory for all dealing with the property for some times now although this was brought in at different times across the country. For the time scale in E6 you should check with your solicitor. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

We note that you do not have an office in E6? Is this a issue? No because like all modern practices we depend on technology to assist us in our work to ensure that matters are dealt with quickly. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes E6.

What SDLT will I pay if I am a first time buyer? First time buyers paying £300,000 or lower for a residential property will pay no SDLT. If you are paying between £300k and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over half a million pounds there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a maisonette what additional costs can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a maisonette what additional fees can we anticipate? We cannot give you all the figures up front in our estimate. The costs charged by landlords and management companies will vary for providing information packs often in a form called LPE1. The charge for this varies from organisation to organisation on average it is approximately £250 but is can be higher in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the maintenance or very small buildings such as a single house converted into two maisonettes.
