Searches on my Conveyancing Quote

What is included in a local authority search covering E9? There are two parts to a local authority search – Local Land Charge Register search and CON29. The second part of the search – Enquiries of the local authority – supplies information relating to whether the roadway abutting the property is maintained at public expense, proposals for new major roads, rail schemes or planning history relating to the house. The replies can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

When we get an Environmental check on the property mentioned on the conveyancing quote for the property in E9 what will it reveal? The search provides details of present and past pollution risks together with a assessment from an environmental consultant confirming whether or not the site might be officially names as contaminated land by the council. It may also reveal other information such as whether the property is within a flood area area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and high radon zone.

Why is a a CON29 DW search salient if you want to extent or alter the land in E9? One of the critical replies shows the location of any public sewer nearby the site you are interested in. This is significant because if you want to build close to a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the works cost more.

General Conveyancing Tips

There is frequently a mortgage loan to apply for and it should be noted that a solicitor cannot rely on a quick email by mortgage broker or anyone else. The conveyancing lawyer must generally have sight of your official written offer of mortgage in order that he may (i) be able to check that you are getting the loan you need and ensure that you can comply with any offer conditions imposed in the mortgage offer.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were traditionally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually retained by your mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the property for some period now although this was brought in at different times across the country. For the time scale in E9 you should check with your lawyer. Thankfully most deeds are now registered and cannot be mislaid. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in E9

Are you able to manage a mortgage with M&S Bank in E9? Yes we are on the mortgage Panel for this lender.

We are aware that you do not have an office in E9? Is this a problem? No because like all modern firms of lawyers we count on technology to assist us in our office to ensure that matters are dealt with promptly. Your proximity to our office is not going to cause a delay. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes E9.

What Stamp Duty will I pay if I am a first time buyer? First time buyers paying £300k or lower for a residential property will pay no Stamp Duty . If you are paying between three hundred thousand pounds and £500k will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of Stamp Duty Land Tax. If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a leasehold what additional payments can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

I have obtained Letters of Administration for my fathers estate. Do you deal with sales by administrators? Yes. As administrators of the Estate you can sell and our fees remain the same as our standard quote for this type of Seller.
