Searches on my Conveyancing Quote

What is not included in a local authority search? Note that local searches are often relevant to only the property you are purchasing and might not cover developments next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your local planning department covering EC1M. Usually, you can search most planning applications on line by postcode or by map search).

Do you recommend that I order an Environmental search on the property that we are buying in EC1M? Yes we including this in our quote. We would always recommend an environmental check on the land parcel you intend to purchase which is available from a number of suppliers including Homecheck. The environmental search results provide details of present and past environmental risks together with a statement from an environmental consultant confirming whether or not the area, based upon the information revealed by the search, would be officially names as contaminated land by the Local Authority.

Apart from showing that the home in EC1M is connected to the mains water supply and mains drainage what other details does a drainage search show? A water authority search shows to a potential interested party that the land they are purchasing does not need a “build over consent” because the vendor has constructed an addition to the house adjacent a public drain. It also shows a raft of other replies such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

There is always likely to be a mortgage to obtain and it should be noted that a conveyancing solicitor cannot rely on a informal confirmation by mortgage broker or anyone else. She will need to have sight of your official written offer of mortgage in order that they may (i) ensure that you are getting the amount you need and be able to check that you can comply with any special conditions imposed in the facility letter.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a estimate what disbursements apply to your matter and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on their legal fees disguised as ‘disbursements’. Make sure that any estimates you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you have everything you are responsible for all outlays needed to sustain the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including EC1M some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the care of the building in which the flat is situated and possibly also building insurance.

FAQs in EC1M

Are you on the panel of Monmouthshire Building Society? Yes we act for all major lenders and many smaller lenders.

Are you able to conduct Lifetime ISAs? Yes we deal with Lifetime ISAs in EC1M.

What is a first time buyer? The characterisation of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the Revenue is an real person who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their home. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a flat what additional fees can we anticipate? This is one tricky area where we cannot give you all the costs up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

I have obtained probate for my parents estate. Do you deal with sales by executors? Yes. As administrators of the Estate you can sell and our expenses remain the same as our standard quote for this type of Seller.
