Searches on my Conveyancing Quote

How long do Enquiries of the local authority search searches take? The ETA for a local search LLC1 can vary significantly, from 24 hours to six weeks! Although we order all our Official Local Authority searches through our search provider’s website some searches are still processed managed manually by the council. Also the search timescale can be affected by seasonal demand levels and Local Authority staffing levels.

I am told that the official local Searches in EC1N will show if the land is contaminated. Is that correct? No. Whilst it is correct that councils are now in the process of locating contaminated properties and recording these land parcels on registers – this is a process which will take a many years to deliver upon. Needless to say any areas entered within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any local authority Search are likely to be incomplete.

Apart from showing that the house in EC1N is connected to the mains water supply and mains drainage what other information does a drainage search show? A a CON29DW verifies to a prospective interested party that the house they are purchasing does not need a “build over consent” because the vendor has constructed an extension within three metres of a public drain. It also shows a raft of other replies such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer timeframe if you are trading selling down and have a lot of items to get rid of. You can quicken the process if it is a first time buy. You may be able to exchange and complete together. However your option depend on what  others in the chain will agree to.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally paper documents – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually retained by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the property for some times now although this was brought in at different times across the country. For the time in EC1N you should check with your conveyancer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in EC1N

Are you on the panel of Fleet Mortgages Limited? Yes we act for all major lenders and many smaller lenders.

Are you able to manage Lifetime ISAs? Yes we deal with Lifetime ISAs in EC1N.

What is a first time buyer? The definition of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the Taxman is an individual who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their home. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am Buying my first house and I already own a share in another home or a buy to let will I pay higher rate stamp duty? This is complex. In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a maisonette what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the figures up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a maisonette what additional fees can we anticipate? We cannot give you all the figures up front in our estimate. The costs charged by freeholder and management companies will vary for providing information packs often in a questionnaire called LPE1. The charge for this varies from organisation to organisation usually it is approximately £200-300 but is can be higher in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the management or very small buildings such as a single house converted into two maisonettes.
