Do I need to get a Enquiries of the local authority search if I’m a cash buyer? Cash buyers do have a choice on what they seek when they are purchasing a land parcel and do not necessarily have to conduct a search. Many such consumers think they know what a local search LLC1 will reveal and may know about the EC1R or surrounding locale however most solicitors will still suggest one. One of the main reasons is that the Official Local Authority search is the only place to reveal liabilities to the local council and this is more commonly the case with probate properties.

I believe that the Land Charges Search in EC1R will show if the land is contaminated. Is that correct? Not really. Whilst it is correct that Local Authorities are now in the process of locating contaminated properties and recording these land on registers – this is a process which will take a unknown period of time to finish. Needless to say any properties listed within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any Con29 Searches are likely to be incomplete.

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond.Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest solicitors for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all expenses necessary to upkeep the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including EC1R some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the leasehold property is situated and possibly also building insurance.

In certain circumstances you will not need to pay this for example if you have recently inherited a share in a property. We would need to advise you specifically on this.

If we are buying a flat what additional costs can we anticipate? This is one tricky area where we cannot give you all the figures up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a leasehold what additional expenses can we anticipate? We cannot give you all the costs up front in our quote. The costs charged by landlords and managing agents will vary for providing information packs often in a form called LPE1. The charge for this varies from organisation to organisation broadly it is around £200 but is can be higher in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the management or very small buildings such as a single house converted into two flats.
