Searches on my Conveyancing Quote

What is included in a local authority search covering EN1? There are two parts to a local authority search – LLC1 and CON29. The Local Land Charges search covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the title, whether the property is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the title is subject to a tree protection order. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

I am told that the Con29 Searches in EN1 will show if the land is contaminated. Is that correct? That is not correct. Whilst it is correct that Local Authorities are now in the process of identifying contaminated land and recording these areas on registers – this is a process which will take a decades to end. Needless to say any sites comprised within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any local authority Search are likely to be incomplete.

Why is a drainage search crucial if you want to extent or alter the home in EN1? One of the crucial details shows the location of any public sewer close to the land you are purchasing. This is significant because if you want to build within three metres of a public drain you might need a ‘Build-over Agreement’ with the water authority. This may stop what you want to build and/or make the works cost more.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond.Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all costs incurred to maintain the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including EN1 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the flat is situated and possibly also building insurance.

What is a first time buyer? The characterisation of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the Revenue is an person who has never owned an interest in any residential property in the England or anywhere else in the world and who intends to occupy the property as their home. If you select “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) complete together. You will pay the normal rates of duty. If you buy a new home before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main residence within 36 months.

If we are buying a leasehold what additional payments can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a flat what additional costs can we anticipate? We cannot give you all the figures up front in our on line quote. The costs charged by freeholder and managing agents will vary for providing responses often in a questionnaire called LPE1. The charge for this varies from company to company mainly it is approximately £200-300 but is can be more in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the maintenance or very small buildings such as a single house converted into a couple leaseholds.
