Searches on my Conveyancing Quote

Do I need to get a Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they seek when they are purchasing a land parcel and do not necessarily have to conduct a search. Many such purchasers think they know what a Local Authority search will reveal and may know about the IG2 or surrounding vicinity however most conveyancers will still recommend one. One of the main reasons is that the Enquiries of the local authority search is the only place to reveal indebtedness to the Local Authority and this is more commonly the case with properties where the owner has gone into a home.

I am advised that the Land Charges Search in IG2 will show if the land is contaminated. Is that correct? That is not correct. Whilst it is correct that Local Authorities are now in the process of locating polluted ground and recording these land parcels on registers – this is a process which will take a number of years to deliver upon. Needless to say any property named within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Searches are likely to be incomplete.

Apart from showing that the house in IG2 is connected to the mains water supply and mains drainage what other results does a water authority search include? A a CON29 DW search confirms to a new owner that the home they are buying does not need a “build over consent” because the previous owner has constructed an addition to the house close to a public drain. It also shows a raft of other information such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer time if you are trading selling down and have a lot of items to clear. You can prompt the process if it is your first purchase. You may be able to exchange and complete together. However your desire depend on what  others in the chain will consent to.

Always check what you are acquiring? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common errors a purchaser makes is not checking the plan properly. It is a good idea to visit the land to check that what is shown on the plan agrees with what you think you’re buying on site. All too often customers mistakenly think that a piece of land at the side or rear of the house is theirs,only to later discover that the legal title to the site doesn’t include this bit of garden. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all outlays needed to maintain the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including IG2 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the leasehold property is situated and possibly also building insurance.

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the Revenue is an real person who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their main residence. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new home before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main home within 3 years.

If we are buying a leasehold what additional payments can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

I have obtained probate for our fathers estate. Do you deal with sales by executors? Yes. As executors of the Estate you can sell and our legal costs remain the same as our standard quote for this type of Seller.

Postcode district boundaries:

The IG postcode area, also known as the Ilford postcode area, is a group of eleven postcode districts in England, within six post towns. These cover parts of east London and south-west Essex. Inward mail for the area is sorted, along with mail for the E and RM postcode areas, at the Romford Mail Centre.

The area served includes much of the London Borough of Redbridge, the western part of the London Borough of Barking and Dagenham and the southwestern part of the Epping Forest district of Essex, while the western part of IG8 covers a small part of the London Borough of Waltham Forest.

The area uses “IG” rather than “IL”, as the latter could be misread as “LL” or “L1”. It is sometimes said that the ‘G’ is used as it is the last letter in Barking, in the south of the area.
