Searches on my Conveyancing Quote

What is included in a local authority search covering IG5? There are two parts to a local authority search – Local Land Charge Register search and Enquiries of the local authority. The LLC1 covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the title, whether the land is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the title is in need of an improvement or renovation grant. All LLC1 registrations are legally binding on successive owners i.e. a buyer.

I believe that the local Searches in IG5 will show if the land is contaminated. Is that correct? No. Whilst it is correct that councils are now in the process of finding contaminated land parcels and recording these land on registers – this is a process which will take a a long time to accomplish. Needless to say any property named within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Search are likely to be incomplete.

Why is a drainage search essential if you want to extent or alter the house in IG5? One of the salient replies shows a map of any public sewer within the house you are buying. This is important because if you want to build adjacent a public drain you might need a ‘Build-over Agreement’ with the water authority. This may hinder what you want to build and/or make the works more expensive.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond.Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a quote what disbursements apply to your sale and check any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on fees disguised as ‘disbursements’. Make sure that any written quotes you obtain contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you own everything you are responsible for all outlays necessary to maintain the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including IG5 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the maintenance of the building in which the flat is located and possibly also building insurance.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new house before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main property within 36 months.

If we are buying a flat what additional fees can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a flat what additional expenses can we anticipate? We cannot give you all the figures up front in our on line quote. The costs charged by landlords and management companies will vary for providing assignment packs often in a questionnaire called LPE1. The charge for this varies from organisation to organisation usually it is around £300 but is can be more in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the management or very small buildings such as a single house converted into two maisonettes.

The IG postcode area, also known as the Ilford postcode area, is a group of eleven postcode districts in England, within six post towns. These cover parts of east London and south-west Essex. Inward mail for the area is sorted, along with mail for the E and RM postcode areas, at the Romford Mail Centre.

The area served includes much of the London Borough of Redbridge, the western part of the London Borough of Barking and Dagenham and the southwestern part of the Epping Forest district of Essex, while the western part of IG8 covers a small part of the London Borough of Waltham Forest.
