Searches on my Conveyancing Quote

What is included in a local authority search covering IG7? There are two parts to a local authority search – Local Land Charge Register search and CON29. The second part of the search – CON29 – supplies information relating to public highways, proposals for new roads, railway schemes or planning decisions relating to the house. The replies can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

I think that the Land Charges Searches in IG7 will show if the land is contaminated. Is that accurate? Not really. Whilst it is correct that Local Authorities are now in the process of finding polluted property and recording these sites on registers – this is a process which will take a decades to end. Needless to say any property comprised within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any Land Charges Searches are likely to be incomplete.

Why is a a CON29DW useful if you want to extent or alter the house in IG7? One of the vital details shows information of any public sewer adjacent the house you are purchasing. This is important because if you want to build near a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the footings more costly.

General Conveyancing Tips

There is always likely to be a mortgage to apply for and it should be noted that a lawyer cannot rely on a oral confirmation by mortgage broker or anyone else. The conveyancing solicitor must have sight of your final written mortgage offer in order that they may (i) be sure that you are getting the amount you need and be sure that you can comply with any special conditions imposed in the mortgage terms.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest practices for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were traditionally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually kept by your mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the property for some time now although this was brought in at different times across the country. For the date in IG7 you should check with your conveyancer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in IG7

Are you able to handle a mortgage with Godiva Mortgages Ltd in IG7? Yes we are on the mortgage Panel for this lender.

We have noticed that you do not have an office in IG7? Is this a problem? No because like all modern practices we depend on technology to assist us in our office to ensure that matters are dealt with rapidly. Your proximity to our office is not important. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes IG7.

What is a first time buyer? The characterisation of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the Inland Revenue is an real person who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their home. If you select “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over forty thousand pounds. If you press “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional payments can we anticipate? This is one tricky area where we cannot give you all the costs up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a flat what additional payments can we anticipate? We cannot give you all the costs up front in our estimate. The costs charged by landlords and management companies will vary for providing information packs often in a pro forma response called LPE1. The charge for this varies from company to company broadly it is approximately £200-300 but is can be more in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into a couple leaseholds.

About IG7.

Postcode district boundaries:

The IG postcode area, also known as the Ilford postcode area, is a group of eleven postcode districts in England, within six post towns. These cover parts of east London and south-west Essex. Inward mail for the area is sorted, along with mail for the E and RM postcode areas, at the Romford Mail Centre.

The area served includes much of the London Borough of Redbridge, the western part of the London Borough of Barking and Dagenham and the southwestern part of the Epping Forest district of Essex, while the western part of IG8 covers a small part of the London Borough of Waltham Forest.

The area uses “IG” rather than “IL”, as the latter could be misread as “LL” or “L1”. It is sometimes said that the ‘G’ is used as it is the last letter in Barking, in the south of the area.
