Do I need to get a Enquiries of the local authority search if I’m a cash buyer? Cash buyers do have a choice on what they obtain when they are purchasing a property and do not necessarily have to conduct a search. Many such purchasers think they know what a Official Local Authority search will reveal and may know about the KT1 or surrounding vicinity however most lawyers will still prescribe one. One of the main reasons is that the Official Local Authority search is the only place to reveal monies due to the Local Authority and this is more commonly the case with probate properties.

I heard that the local Searches in KT1 will show if the land is contaminated. Is that correct? Not really. Whilst it is correct that councils are now in the process of finding contaminated land and recording these land parcels on registers – this is a process which will take a an uncertain amount of time to end. Needless to say any ground comprised within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any local authority Enquiries are likely to be incomplete.

Why is a drainage search fundamental if you want to extent or alter the land parcel in KT1? One of the main results shows a map of any public sewer on the site you are buying. This is worth knowing because if you want to build near a public drain you might need a ‘Build-over Agreement’ with the water authority. This may hinder what you want to build and/or make the design cost more.

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond.Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when checking a estimate what disbursements apply to your purchase and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £99 cheaper than Firm A, but what about that unusual ‘disbursement’ of £140 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on costs disguised as ‘disbursements’. Make sure that any quotes you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you own everything you are responsible for all outlays needed to uphold the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including KT1 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the leasehold property is located and possibly also building insurance.

If we are buying a maisonette what additional payments can we anticipate? This is one tricky area where we cannot give you all the costs up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a flat in a retirement development what additional payments can we anticipate? We cannot give you all the figures up front in our on line quote. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing responses often in a form called LPE1. The charge for this varies from organisation to organisation usually it is around £200 but is can be more in rare cases. Second, the lease usually contains a mechanism for the selling to pay a fee to the landlord based on a percentage of the sale price which is sometimes 1% although other formula may be used. The lease will need to be checked carefully.
