How long do Enquiries of the local authority search searches take? The timescale for a Enquiries of the local authority search can vary significantly, from 24 hours to six weeks! Although we order all our Enquiries of the local authority search through our search provider’s website some searches are still processed handled manually by the Local Authority. Also the search ETA can be affected by seasonal demand levels and council staffing levels.

I think that the local Enquiries in KT4 will show if the land is contaminated. Is that right? That is not right. Whilst it is correct that councils are now in the process of finding polluted land and recording these land on registers – this is a process which will take a a long time to end. General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer time if you are trading selling down and have a lot of items to get rid of. You can accelerate the process if it is your first purchase. You may be able to exchange and complete simultaneously. However your choice depend on what  others in the chain will allow.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when examining a estimate what disbursements apply to your sale and check any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £50 cheaper than Firm A, but what about that unusual ‘disbursement’ of £140 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound cheaper by adding on their legal fees disguised as ‘disbursements’. Make sure that any estimates you obtain contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main house within three years.

If we are buying a leasehold what additional payments can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.
