Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional queries that are not covered by the standard local authority search. These include: environmental enquiries in KT9? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clear-up); water authority searches (which show any publicly owned sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

Do you recommend that both of us get an Environmental check on the property that we are buying in KT9? Yes we including this in our quote. We would always recommend an environmental check on the properties you intend to purchase which is available from a number of search providers including Landmark. The environmental enquiry results provide details of present and past environmental risks together with a certificate from an environmental consultant confirming whether or not the properties, based upon the information revealed by the search, would be classified contaminated land by the local council.

Why is a Drainage & Water Enquiry indispensable if you want to extent or alter the property in KT9? One of the important replies shows the location of any public sewer close to the property you are purchasing. This is important because if you want to build adjacent a public drain you might need a ‘Build-over Agreement’ with the water authority. This may restrict what you want to build and/or make the build more costly.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

We dealt with Mouzzam who was very quick at replying and managed to complete the property purchase in less than a month. I couldn’t recommend them enough. Great service Excellent service provided by Mouzzam Yamin. Very quick full responses to all contact made. Mouzzam handled everything extremely quickly and diligently on his end, and certainly put the other side’s conveyancer to shame. Would definitely use again in the future and recommend to friends / family if they need the service.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

Remember there are invariably several related purchases involved in the “chain” and the interdependence of these purchases means that everyone moves at the pace of the slowest sale.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest solicitors for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you own everything you are responsible for all expenses needed to repair the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including KT9 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to contribute jointly to the care of the building in which the flat is located and possibly also building insurance.

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying £300k or lower for a residential property will pay no Stamp Duty . If you are paying between £300k and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of SDLT. If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

What Stamp Duty Land Tax if I am buying a buy to let in KT9? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40k. If you chose “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional expenses can we anticipate? This is one tricky area where we cannot give you all the figures up front in our on line quote. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a house in a retirement development what additional disbursements can we anticipate? We cannot give you all the disbursements up front in our on line quote. There are going to be two potential costs. First, the costs charged by freeholder and managing agents will vary for providing information often in a pro forma response called LPE1. The charge for this varies from organisation to organisation mainly it is approximately £200-300 but is can be higher in extreme cases. Second, the lease often contains a provision for the assignor to pay a charge to the freeholder based on a % of the market value which is often 1% although other formula may be used. The lease will need to be checked carefully.
