Searches on my Conveyancing Quote

What is included in a local authority search covering N11? There are two parts to a local authority search – LLC1 and Enquiries of the local authority. The second part of the search – CON29 – supplies information relating to whether the roadway abutting the property is public or private, proposals for new major roads, rail schemes or building consents relating to the land. The responses can also include outstanding statutory notices, breaches of planning or building regulations or the existence of a compulsory purchase order. Environmental factors, such as whether the house stands on contaminated land or in a Radon gas affected area are also covered but see out comments on Environmental Searches also.

I heard that the local Search in N11 will show if the land is contaminated. Is that correct? That is not right. Whilst it is correct that Local Authorities are now in the process of identifying contaminated land and recording these areas on registers – this is a process which will take a many years to finish. Needless to say any land parcels comprised within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Enquiries are likely to be incomplete.

What is a drainage search ? A a CON29DW confirms to a prospective interested party that the land they are buying is connected to the mains water supply and mains drainage. This is particularly significant in parts of N11 which are agricultural areas as there may be a a private drainage system.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer timeframe if you are trading selling down and have a lot of items to get rid of. You can accelerate the process if it is a first time buy. You may be able to exchange and complete on the same day. However your instructions depend on what  others in the chain will allow.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when getting a quote what disbursements apply to your sale and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £75 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on their fees disguised as ‘disbursements’. Make sure that any quotes you obtain contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all costs necessary to sustain the fabric of the building. Leasehold usually applies to flats or maisonettes although in some parts of the country including N11 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to pay jointly to the care of the building in which the leasehold property is situated and possibly also building insurance.

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying £300k or lower for a residential property will pay no Stamp Duty . If you are paying between £300k and £500,000 will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you press “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the SDLT position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over £40k. If you select “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional fees can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a maisonette in a retirement development what additional payments can we anticipate? We cannot give you all the figures up front in our quote. There are going to be two potential costs. First, the costs charged by landlords and managing agents will vary for providing information often in a questionnaire called LPE1. The charge for this varies from organisation to organisation on average it is around £200-300 but is can be higher in unusual cases. Second, the lease often contains a clause for the selling to pay a fee to the management company based on a percentage of the sale price which is sometimes around 1-2% although other formula may be used. The lease will need to be checked carefully.
