Searches on my Conveyancing Quote

What is included in a local authority search covering N16? There are two parts to a local authority search – Local Land Charge Register search and Enquiries of the local authority. The LLC1 covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the house, whether the property is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the house is subject to a tree protection order. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

I am told that the local Enquiries in N16 will show if the land is contaminated. Is that correct? That is not correct. Whilst it is correct that councils are now in the process of identifying polluted land parcels and recording these properties on registers – this is a process which will take a unknown period of time to accomplish. Needless to say any ground entered within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Search are likely to be incomplete.

Apart from showing that the land in N16 is connected to the mains water supply and mains drainage what other information does a water authority search include? A drainage search confirms to a prospective purchaser that the property they are acquiring does not need a “build over consent” because the vendor has constructed an addition to the house near a public drain. It also shows a raft of other details such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer time if you are trading buying down and have a lot of items to clear. You can prompt the process if it is your first purchase. You may be able to exchange and complete on the same day. However your choice depend on what  others in the chain will consent to.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when examining a estimate what disbursements apply to your purchase and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £75 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on their fees disguised as ‘disbursements’. Make sure that any estimates you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you own everything you are responsible for all costs necessary to repair the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including N16 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the leasehold property is located and possibly also building insurance.

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the the Government is an person who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their main house. If you press “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

What SDLT if I am buying a second home in N16? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty for each band for all property over forty thousand pounds. If you chose “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional payments can we anticipate? This is one tricky area where we cannot give you all the costs up front in our quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £600. This is why the government is considering regulating this area.

If we are selling a maisonette what additional payments can we anticipate? We cannot give you all the costs up front in our quote. The costs charged by freeholder and management companies will vary for providing assignment packs often in a questionnaire called LPE1. The charge for this varies from organisation to organisation broadly it is around £250 but is can be more in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the maintenance or very small buildings such as a single house converted into 2 flats.
