Do I need to get a Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they obtain when they are purchasing a land parcel and do not necessarily have to conduct a search. Many such consumers think they know what a Enquiries of the local authority search will reveal and may know about the N19 or surrounding vicinity however most lawyers will still advise one. One of the main reasons is that the Local Authority search is the only place to reveal indebtedness to the Local Authority and this is more commonly the case with probate properties.

Why do we need environmental enquiries in N19? Statutory legislation have resulted in a clean-up system for contaminated sites. The basic position is that the polluter should clear-up however where that party is missing (for example because the work was done some time ago or the company has gone into insolvency the liability for clean-up costs passes to the current owner (who could be you). Even if you are purchasing an leasehold in N19 you may find that you are liable for the cost of any clear-up through the maintenance charge provisions of the lease.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer time if you are trading selling down and have a lot of items to get rid of. You can speed the process if it is your first buy. You may be able to exchange and complete together. However your choice depend on what  others in the chain will comply with.

Always check what you are acquiring? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the most common mistakes a client makes is not checking the plan properly. It is a best to go to the land to check that what is shown on the plan agrees with what you think you’re looking at on site. All too often purchasers mistakenly think that a piece of land at the side or rear of the site is theirs,only to discover that the legal title to the home doesn’t include this space. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all bills necessary to upkeep the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including N19 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few pounds to the freeholder each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the leasehold property is located and possibly also building insurance.

This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a leasehold what additional costs can we anticipate? We cannot give you all the expenses up front in our estimate. The costs charged by landlords and managing agents will vary for providing assignment packs often in a pro forma response called LPE1. The charge for this varies from company to company mainly it is around £250 but is can be more in extreme cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into 2 maisonettes.
