What is not included in a local authority search? There are a number of additional queries that are not covered by the standard local authority search. These include: environmental investigations in N7? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a remediation); water authority searches (which show any mains sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

Do you recommend that we get an Environmental investigation on the property that we are buying in N7? Yes we including this in our quote. We would always recommend an environmental search on the ground you intend to purchase which is available from a number of search providers including Argyll Site Solutions. The environmental search results provide details of present and past environmental risks together with a assessment from an environmental expert confirming whether or not the site, based upon the information revealed by the search, might be classified contaminated land by the London Borough/council.

What is a drainage search ? A drainage search confirms to a new owner that the home they are acquiring is connected to the mains water supply and mains drainage. This is particularly worth knowing in parts of N7 which are not built up as there may be a a private drainage system.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond.Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

Always check what you are purchasing? We will always send you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest mistakes a buyer makes is not checking the plan properly. It is a good idea to go to the land to check that what is shown on the plan agrees with what you think you’re acquiring on site. All too often consumers mistakenly think that a piece of land at the side or rear of the home is theirs,only to discover that the legal title to the land parcel doesn’t include this site. Always be satisfied that the title plan matches the physical position at the property.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all costs incurred to sustain the fabric of the structure. Leasehold usually applies to flats or maisonettes although in some parts of the country including N7 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a small ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the freeholder setting out the rights and obligations including the requirement to pay jointly to the upkeep of the building in which the leasehold property is situated and possibly also building insurance.

If the price is over £500k there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

What SDLT if I am buying a buy to let in N7? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40k. If you chose “yes” to the “Buy to Let/Second Owner” question on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional costs can we anticipate? This is one tricky area where we cannot give you all the figures up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

We have obtained probate for our mother estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our fees remain the same as quoted for this type of Seller.
