Searches on my Conveyancing Quote

Do I need to get a local search LLC1 if I’m a cash buyer? Cash buyers do have a choice on what they seek when they are purchasing land and do not necessarily have to conduct a search. Many such clients think they know what a local search LLC1 will reveal and may know about the NW2 or surrounding vicinity however most conveyancing lawyers will still suggest one. One of the main reasons is that the Enquiries of the local authority search is the only place to reveal debts to the local council and this is more commonly the case with probate properties.

When we ask for a Environmental check on the property mentioned on the conveyancing quote for the property in NW2 what will it reveal? The search provides results of present and past contamination risks together with a statement from an environmental expert confirming whether or not the land parcel might be officially names as contaminated land by the London Borough/council. It may also reveal other information such as whether the property is within a flood risk area (which may have an effect on the availability and cost of home insurance), whether it is on or near a landfill site and in an area of high subsidence or landslip. It may also shown whether the property is affected by coal mining and in an area with high radon readings.

Why is a drainage search important if you want to extent or alter the house in NW2? One of the main results shows information of any public sewer nearby the land parcel you are interested in. This is important because if you want to build near a public drain you might need a ‘Build-over Agreement’ with the water authority. This may limit what you want to build and/or make the addition more costly.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

Top class solicitors, I was dealing with Mouzzam Yamin who handled everything very professionally especially when things were at difficult stages. They thoroughly make sure in protecting your interests and keep business professional. Hassle free process on recent property purchase with regular updates from Mouzzam Yamin, and all done at a reasonable fee.

Remember if the process drags on, we will not hit you with additional charges.

Our price is fixed.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer timeframe if you are trading buying down and have a lot of items to clear. You can quicken the process if it is your first buy. You may be able to exchange and complete together. However your instructions depend on what  others in the chain will agree to.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of linked parties in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a commercial relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually stored by your mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the deeds for some period now although this was brought in at different times across the country. For the date in NW2 you should check with your solicitor. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in NW2

Are you able to manage a mortgage with Cynergy Bank in NW2? Yes we are on the mortgage Panel for this lender.

We note that you do not have an office in NW2? Is this a issue? No because like all modern solicitors we depend on technology to assist us in our practice to ensure that matters are dealt with promptly. Your proximity to our office is not significant. We are also authorised by the Solicitors Regulation Authority to carry out work throughout England and Wales (which obviously includes NW2.

What is a first time buyer? The description of a first time buyer may differ from your mortgage product when considering Stamp Duty Land Tax. A first time buyer according to the the Government is an real person who has never owned an interest in any residential property in the United Kingdom or anywhere else in the world and who intends to occupy the property as their main house. If you select “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I buy a new home to live in but do not sell my present house what is the Stamp Duty position? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of Stamp Duty Land Tax for each band for all property over £40,000. If you select “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a maisonette what additional fees can we anticipate? This is one tricky area where we cannot give you all the disbursements up front in our on line quote. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a leasehold in a retirement development what additional payments can we anticipate? We cannot give you all the costs up front in our estimate. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing information often in a form called LPE1. The charge for this varies from organisation to organisation often it is around £300 but is can be higher in rare cases. Second, the lease usually contains a mechanism for the assignor to pay a payment to the freeholder based on a % of the sale price which is often 1% although other formula may be used. The lease will need to be checked carefully.
