What is not included in a local authority search? Note that local searches are often relevant to only the title you are purchasing and might not cover developments next door or located a short distance away. (Tip: in this instance you may wish to make additional enquiries at your planning department covering NW5. How long do conveyancing searches take? This depends on how quickly each organisation takes to respond.Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a estimate what disbursements apply to your sale and question any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £50 cheaper than Firm A, but what about that unusual ‘disbursement’ of £140 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on costs disguised as ‘disbursements’. Make sure that any quotes you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the land it stands on. As you own everything you are responsible for all expenses necessary to uphold the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including NW5 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. This is why the government is considering regulating this area.

If we are selling a maisonette in a retirement development what additional expenses can we anticipate? We cannot give you all the costs up front in our on line quote. There are going to be two potential costs. First, the costs charged by landlords and management companies will vary for providing replies often in a questionnaire called LPE1. The charge for this varies from company to company broadly it is approximately £200 but is can be higher in unusual cases. Second, the lease often contains a clause for the selling to pay a fee to the freeholder based on a percentage of the market value which is often 1% although other formula may be used.
