What is a Local Authority Search and why is it needed in NW8? Whilst this is to a solicitors and banks and building societies an indispensable element of the home buying process to customers the need for this may be somewhat of a mystery. However the search reveals relevant|applicable|appropriate|useful information for your matter. In limited cases the replies can be used to change your the purchase price or and may even make you abort from the matter.

I think that the local Enquiries in NW8 will show if the land is contaminated. Is that correct? No. Whilst it is correct that councils are now in the process of finding polluted property and recording these properties on registers – this is a process which will take a unknown period of time to accomplish. Needless to say any areas named within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any local authority Searches are likely to be incomplete.

What is a drainage search ? A a CON29DW confirms to a future purchaser that the house they are buying is connected to the mains water supply and mains drainage. This is particularly significant in parts of NW8 which are farming areas as there may be a a private drainage system.

⭐️⭐️⭐️⭐️⭐️ Reviews of our Service

Top class solicitors, I was dealing with Mouzzam Yamin who handled everything very professionally especially when things were at difficult stages. They thoroughly make sure in protecting your interests and keep business professional. Hassle free process on recent property purchase with regular updates from Mouzzam Yamin, and all done at a reasonable fee.

Remember if the process drags on, we will not hit you with additional charges.

General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer period if you are trading trading down and have a lot of items to get rid of. You can prompt the process if it is your first purchase. You may be able to exchange and complete together. However your option depend on what  others in the chain will consent to.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when looking at a quote what disbursements apply to your matter and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £50 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In truth it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on their legal fees disguised as ‘disbursements’. Make sure that any estimates you get contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were traditionally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually kept by your mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the property for some times now although this was brought in at different times across the country. For the date in NW8 you should check with your conveyancer. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in NW8

Are you on the panel of Lloyds Bank? Yes we act for all major lenders and many smaller lenders.

Are you able to conduct Help to Buy ISAs in NW8? Yes we are on the panel so we can deal with Help to Buy ISAs.

What is a first time buyer? The definition of a first time buyer may differ from your mortgage product when considering Stamp Duty . A first time buyer according to the Taxman is an person who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their home. If you select “yes” to the “First Time Buyer” option on the conveyancing quote the correct rate will calculate for you.

What Stamp Duty if I am buying a buy to let in NW8? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over forty thousand pounds. If you select “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional costs can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

We are executors of our family estate. Do you deal with sales by executors? Yes. As administrators of the Estate you can sell and our legal fees remain the same as our standard quote for this type of Seller.
