Searches on my Conveyancing Quote

Do I need to get a Enquiries of the local authority search if I’m a cash buyer? Cash buyers do have a choice on what they order when they are purchasing a property and do not necessarily have to conduct a search. Many such buyers think they know what a Official Local Authority search will reveal and may know about the RM1 or surrounding vicinity however most lawyers will still counsel for one. One of the main reasons is that the local search LLC1 is the only place to reveal debts to the Local Authority and this is more commonly the case with probate properties.

I am told that the local Searches in RM1 will show if the land is contaminated. Is that correct? That is not right. Whilst it is correct that councils are now in the process of locating contaminated property and recording these sites on registers – this is a process which will take a an uncertain amount of time to finish. Needless to say any areas listed within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any local authority Search are likely to be incomplete.

What is a drainage search ? A a CON29DW confirms to a new owner that the land they are acquiring is connected to the mains water supply and mains drainage. This is particularly important in parts of RM1 which are farming areas as there may be a a private drainage system.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond.Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of vested interests in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a payment relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were traditionally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually kept by a mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the land for some period now although this was brought in at different times across the country. For the time period in RM1 you should check with your lawyer. Thankfully most deeds are now registered and cannot be destroyed. You can request a refund for the amount above the normal Stamp Duty rates provided you sell your previous main home within three years.

This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.
