Searches on my Conveyancing Quote

How long do Enquiries of the local authority search searches take? The wait time for a Local Authority search can vary significantly, from 24 hours to six weeks! Although we order all our Official Local Authority searches through an electronic search provider some searches are still processed completed manually by the local council. Also the search wait time can be affected by seasonal demand levels and Local Authority staffing levels.

Do you recommend that both of us get an Environmental search on the property that we are buying in RM10? Yes we including this in our quote. We would always recommend an environmental search on the land you intend to purchase which is available from a number of search providers including Argyll Site Solutions. The environmental enquiry results provide details of present and past environmental risks together with a assessment from an environmental consultant confirming whether or not the site, based upon the information revealed by the search, would be classified contaminated land by the council.

Apart from showing that the property in RM10 is connected to the mains water supply and mains drainage what other replies does a a CON29 DW search show? A a CON29DW shows to a prospective interested party that the property they are acquiring does not need a “build over consent” because the seller has constructed an alteration over a public drain. It also shows a raft of other results such as water quality and historical evidence of internal sewer flooding.

General Conveyancing Tips

Remember there are always likely to be many related sales involved in the “chain” and the interdependence of these purchases means that everyone moves at the pace of the slowest link in the chain.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by lawyers to third parties such as search fees and Land Registry fees and stamp duty. Double check when examining a estimate what disbursements apply to your purchase and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £75 cheaper than Firm A, but what about that unusual ‘disbursement’ of £140 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound more competitive by adding on their legal fees disguised as ‘disbursements’. Make sure that any written quotes you download contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually stored by your mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the deeds for some time now although this was brought in at different times across the country. For the time period in RM10 you should check with your conveyancer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

FAQs in RM10

Are you able to conduct a mortgage with Royal Bank of Scotland in RM10? Yes we are on the mortgage Panel for this lender.

Are you able to deal with Lifetime ISAs? Yes we deal with Lifetime ISAs in RM10.

What Stamp Duty Land Tax will I pay if I am a first time buyer? First time buyers paying £300k or less for a residential property will pay no Stamp Duty . If you are paying between £300k and half a million pounds will pay SDLT at 5% on the amount of the purchase price in excess of three hundred thousand pounds – a reduction of £5,000 compared to standard rates of SDLT. If the price is over half a million pounds there is no relief for the first time buyer and the normal rates apply. If you chose “yes” to the “First Time Buyer” toggle on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new property before you sell (even if the gap is 24 hours then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main home within three years.

If we are buying a flat what additional payments can we anticipate? This is one tricky area where we cannot give you all the figures up front in our quote. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a freeholder and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £650. This is why the government is considering regulating this area.

If we are selling a flat what additional costs can we anticipate? We cannot give you all the figures up front in our quote. The costs charged by landlords and management companies will vary for providing information often in a form called LPE1. The charge for this varies from organisation to organisation broadly it is around £200 but is can be higher in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the maintenance or very small buildings such as a single house converted into a couple leaseholds.
