How long do Enquiries of the local authority search searches take? The timescale for a Official Local Authority search can vary significantly, from 24 hours to six weeks! Although we order all our Official Local Authority searches through our search provider’s website some searches are still processed processed manually by the Local Authority. Also the search wait time can be affected by seasonal demand levels and council staffing levels.

Do you recommend that we get an Environmental search on the property that we are buying in RM14? Yes we including this in our quote. The environmental search results provide details of present and past environmental risks together with a statement from an environmental expert confirming whether or not the area, based upon the information revealed by the search, might be officially names as contaminated land by the council.

General Conveyancing Tips

There is often a mortgage loan to arrange and it should be noted that a conveyancing lawyer cannot rely on a “nod and a wink” by mortgage broker or anyone else. The Solicitor must have sight of your formal written offer of mortgage in order that she may (i) ensure that you are getting the advance you need and ensure that you can comply with any lender’s conditions imposed in the mortgage terms.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the property transaction; estate agents, mortgage brokers and mortgage lenders might all suggest firms of lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What are the title deeds? The title deeds are the documents showing ownership of a house or flat. Historically these were traditionally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually kept by a mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the land for some time now although this was brought in at different times across the country. For the time period in RM14 you should check with your lawyer. Thankfully most deeds are now registered and cannot be lost. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

This is because leases vary in their requirements and also the costs charged by landlords and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.
