Do I need to get a Local Authority search if I’m a cash buyer? Cash buyers do have a choice on what they seek when they are purchasing a property and do not necessarily have to conduct a search. Many such consumers think they know what a Official Local Authority search will reveal and may know about the RM6 or surrounding locale however most conveyancing solicitors will still suggest one. One of the main reasons is that the Enquiries of the local authority search is the only place to reveal debts to the Local Authority and this is more commonly the case with properties where the owner has gone into a home.

When we order a Environmental check on the property mentioned on the conveyancing quote for the property in RM6 what will it reveal? The search provides details of present and past pollution risks together with a report from an environmental consultant confirming whether or not the property might be designated contaminated land by the local council. General Conveyancing Tips

How long between exchange and completion? This is usually two weeks, but does not have to be. You can request a longer time if you are trading buying down and have a lot of items to clear. You can quicken the process if it is a first time buy. You may be able to exchange and complete on the same day. However your choice depend on what  others in the chain will allow.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when examining a quote what disbursements apply to your sale and query any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £125 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In reality it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on their legal fees disguised as ‘disbursements’. Make sure that any estimates you obtain contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were traditionally bundles of papers – there are known as ‘unregistered title deeds’ but these days the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The original paper deeds are usually kept by your mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the property for some time now although this was brought in at different times across the country. For the date in RM6 you should check with your conveyancer. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

If we are buying a flat what additional payments can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and managing agents also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a leasehold what additional disbursements can we anticipate? We cannot give you all the figures up front in our estimate. The costs charged by landlords and managing agents will vary for providing replies often in a form called LPE1. The charge for this varies from organisation to organisation on average it is around £200-300 but is can be higher in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the management or very small buildings such as a single house converted into a couple leaseholds.
