How long do Official Local Authority search searches take? The ETA for a Enquiries of the local authority search can vary significantly, from 24 hours to six weeks! Although we order all our Enquiries of the local authority search through an electronic search provider some searches are still processed processed manually by the Local Authority. Also the search wait time can be affected by seasonal demand levels and council staffing levels.

I heard that the official local Search in SE1 will show if the land is contaminated. Is that right? Not really. Whilst it is correct that councils are now in the process of finding polluted areas and recording these areas on registers – this is a process which will take a many years to complete. Needless to say any properties comprised within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any local authority Enquiries are likely to be incomplete.

Why is a water authority search salient if you want to extent or alter the property in SE1? One of the salient results shows the location of any public sewer nearby the land parcel you are acquiring. This is worth knowing because if you want to build near a public drain you might need a ‘Build-over Agreement’ with the water authority. This may restrict what you want to build and/or make the design more expensive.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond.Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

Always check what you are acquiring? We will always show you a document known as the ‘title plan’ (sometimes called filed plan}. This will show the full outline of the property you are buying – the boundary will usually be marked red. One of the biggest mistakes a consumer makes is not checking the plan properly. It is a good idea to visit the property to check that what is shown on the plan agrees with what you think you’re purchasing on site. All too often customers mistakenly think that a piece of land at the side or rear of the house is theirs,only to later discover that the legal title to the site doesn’t include this area. Always be satisfied that the title plan matches the physical position at the property.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually stored by your mortgage lender or solicitor. If these deeds are mislaid this can cause problems. Registration has been compulsory for all dealing with the land for some time now although this was brought in at different times across the country. For the date in SE1 you should check with your conveyancer. Thankfully most deeds are now registered and cannot be destroyed. The cost of obtaining ‘official copies’ of the title are included in the conveyancing quote.

If we are buying a maisonette what additional disbursements can we anticipate? This is one tricky area where we cannot give you all the figures up front in our estimate. This is because leases vary in their requirements and also the costs charged by landlords and managing agents also vary. They can also be two parties to deal with i.e a freeholder and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £550. This is why the government is considering regulating this area.

If we are selling a flat what additional fees can we anticipate? We cannot give you all the costs up front in our on line quote. The costs charged by landlords and management companies will vary for providing information packs often in a pro forma response called LPE1. The charge for this varies from organisation to organisation mainly it is around £200-300 but is can be higher in rare cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the maintenance or very small buildings such as a single house converted into a couple flats.
