Searches on my Conveyancing Quote

What is included in a local authority search covering SE12? There are two parts to a local authority search – Local Land Charge Register search and Enquiries of the local authority. The LLC1 covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the land, whether the land is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the property is situated in a smoke control zone. All LLC1 registrations are legally binding on successive owners i.e. a buyer.

I believe that the official local Searches in SE12 will show if the land is contaminated. Is that accurate? That is not right. Whilst it is correct that Local Authorities are now in the process of locating polluted land and recording these sites on registers – this is a process which will take a a long time to complete. Needless to say any property comprised within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any Con29 Enquiries are likely to be incomplete.

Why is a a CON29 DW search significant if you want to extent or alter the land parcel in SE12? One of the essential replies shows the location of any public sewer on the site you are buying. This is worth knowing because if you want to build over a public drain you might need a ‘Build-over Agreement’ with the water authority. This may control what you want to build and/or make the works more expensive.

General Conveyancing Tips

Remember there are more often than not one or more linked transactions involved in the “chain” and the interdependence of these sales means that everyone moves at the pace of the slowest link in the chain.

The Legal Ombudsman advises “Be wary of referrals and recommendations” There are lots of players in the conveyancing transaction; estate agents, mortgage brokers and mortgage lenders might all suggest lawyers for you to use. They may make this sound like it is essential for your matter to use these firms. Whilst some are genuine recommendations often there might be a paid referral relationship behind the recommendation. Ask how much your agent is being paid by the lawyer – you may be surprised at the amount – if they are properly regulated they are meant to tell you. If you want to read more about referral fees see this article from the Daily Mail. Remember that you are free to choose your own lawyer.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the property it stands on. As you have everything you are responsible for all outlays required to repair the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including SE12 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a nominal ground rent of a few hundred pounds to the freeholder each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the flat is situated and possibly also building insurance.

FAQs in SE12

Are you on the panel of HSBC Bank plc? Yes we act for all major lenders and many smaller lenders.

Are you able to manage Help to Buy ISAs in SE12? Yes we are on the panel so we can deal with Help to Buy ISAs.

What is a first time buyer? The classification of a first time buyer may differ from your mortgage product when considering SDLT. A first time buyer according to the the Stamp Office is an individual who has never owned an interest in any residential property in the UK or anywhere else in the world and who intends to occupy the property as their main home. If you chose “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

What SDLT if I am buying a second home in SE12? Buyers of additional residential properties, such as second homes and buy-to-let properties, will have to pay an extra 3% in on top of current rates of SDLT for each band for all property over forty thousand pounds. If you press “yes” to the “Buy to Let/Second Owner” option on the conveyancing quote the correct rate will calculate for you.

If we are buying a flat what additional payments can we anticipate? This is one tricky area where we cannot give you all the expenses up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and management companies who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

We have obtained probate for my fathers estate. Do you deal with sales by administrators? Yes. As executors of the Estate you can sell and our legal fees remain the same as quoted for this type of Seller.
