Searches on my Conveyancing Quote

What is included in a local authority search covering SE18? There are two parts to a local authority search – LLC1 and Enquiries of the local authority. The LLC1 covers any charges or attendant restrictions relating to land or property. These can include information on debts due to the local authority which are attached to the title, whether the title is a listed building or located in a conservation area, subject to any planning agreements and conditional planning permissions and a host of other information including whether the land is subject to a tree protection order. All Local Land Charge registrations are legally binding on successive owners i.e. a buyer.

I am told that the local Search in SE18 will show if the land is contaminated. Is that accurate? No. Whilst it is correct that councils are now in the process of locating contaminated land parcels and recording these land parcels on registers – this is a process which will take a unknown period of time to finish. Needless to say any properties comprised within these areas will be difficult to sell in the future. Unfortunately these records although disclosed by any local Search are likely to be incomplete.

Why is a a CON29DW fundamental if you want to extent or alter the site in SE18? One of the essential results shows a map of any public sewer nearby the house you are interested in. This is significant because if you want to build within three metres of a public drain you might need a ‘Build-over Agreement’ with the water authority. This may limit what you want to build and/or make the build more costly.

General Conveyancing Tips

How long do conveyancing searches take? This depends on how quickly each organisation takes to respond.Many local authorities will turn searches round in about a week, some in a matter of days, but some can take up to six weeks to respond.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancing solicitors to third parties such as search fees and Land Registry fees and stamp duty. Double check when getting a quote what disbursements apply to your sale and purchase and ask about any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £99 cheaper than Firm A, but what about that unusual ‘disbursement’ of £125 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on their fees disguised as ‘disbursements’. Make sure that any estimates you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What are the title deeds? The title deeds are the documents showing ownership of a property. Historically these were originally bundles of papers – there are known as ‘unregistered title deeds’ but now the Land Registry stores evidence of the title electronically – this is referred to as a registered title. The unregistered title deeds are usually stored by your mortgage lender or solicitor. If these deeds are destroyed this can cause problems. Registration has been compulsory for all dealing with the property for some time now although this was brought in at different times across the country. For the date in SE18 you should check with your conveyancer. Thankfully most deeds are now registered and cannot be lost. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £450. This is why the government is considering regulating this area.

If we are selling a maisonette what additional costs can we anticipate? We cannot give you all the expenses up front in our estimate. The costs charged by landlords and managing agents will vary for providing responses often in a form called LPE1. The charge for this varies from organisation to organisation usually it is around £300 but is can be higher in unusual cases. Also in some cases you may not be charged – this will be restricted usually to either share of freehold where the residents run the block or very small buildings such as a single house converted into a couple leaseholds.
