Searches on my Conveyancing Quote

What is not included in a local authority search? There are a number of additional queries that are not covered by the standard local authority search. These include: environmental enquiries in SM3? (to determine a risk of flooding for example, as well as the proximity of any waste sites or potentially contaminated sites which may need a clean-up); water authority searches (which show any publicly owned sewers within the boundaries of the property which could impact upon future building or development). In certain areas additional searches such as mining searches may be advised.

I believe that the Land Charges Searches in SM3 will show if the land is contaminated. Is that right? No. Whilst it is correct that councils are now in the process of identifying polluted properties and recording these properties on registers – this is a process which will take a unknown period of time to finish. Needless to say any property comprised within these locations will be difficult to sell in the future. Unfortunately these records although disclosed by any official local Searches are likely to be incomplete.

Why is a a CON29DW decisive if you want to extent or alter the house in SM3? One of the decisive results shows the location of any public sewer nearby the site you are interested in. This is significant because if you want to build near a public drain you might need a ‘Build-over Agreement’ with the water authority. This may stop what you want to build and/or make the design more expensive.

General Conveyancing Tips

Remember there are always likely to be one or more related sales involved in the “chain” and the interdependence of these purchases means that everyone moves at the pace of the slowest transaction.

The Legal Ombudsman advises “Be wary of hidden costs, disbursements and VAT”. Disbursements are sums paid by conveyancers to third parties such as search fees and Land Registry fees and stamp duty. Double check when examining a quote what disbursements apply to your matter and check any disbursements that haven’t been mentioned by other firms. For example, Firm B might quote legal fees at £50 cheaper than Firm A, but what about that unusual ‘disbursement’ of £150 that Firm B is charging as an ‘expedition fee’? In practice it may not really be a disbursement at all, but might be a way of Firm B making their overall quote sound better by adding on costs disguised as ‘disbursements’. Make sure that any estimates you order contain all costs, disbursements and VAT. Beware of quotes that look a lot cheaper than others – as the saying goes, if it looks too good to be true, it probably is.

What is the difference between freehold and leasehold property? If you own a freehold property it invariable means you own a house or bungalow and that includes the whole building and the ground it stands on. As you own everything you are responsible for all bills necessary to upkeep the fabric of the house. Leasehold usually applies to flats or maisonettes although in some parts of the country including SM3 some houses are also leasehold. Leasehold means you effectively lease a property for a number of years – usually a very long period of 99, 125 or even 999 years. You may pay a minor ground rent of a few hundred pounds to the landlord each year. For leasehold there will be a lease agreement with the landlord setting out the rights and obligations including the requirement to contribute jointly to the upkeep of the building in which the flat is situated and possibly also building insurance.

What SDLT will I pay if I am a first time buyer? First time buyers paying £300k or lower for a residential property will pay no Stamp Duty . If you are paying between £300,000 and half a million pounds will pay SDLT at 5% on the amount of the purchase price in excess of £300,000 – a reduction of £5,000 compared to standard rates of Stamp Duty . If the price is over £500,000 there is no relief for the first time buyer and the normal rates apply. If you select “yes” to the “First Time Buyer” question on the conveyancing quote the correct rate will calculate for you.

If I am buying and selling a home which I live in and I own a buy to let will I pay higher rate stamp duty? No provided both properties (sale and purchase) go through together. You will pay the normal rates of duty. If you buy a new residence before you sell (even if the gap is 1 day then you need to pay the higher rate of duty and then claim it back. You can request a refund for the amount above the normal Stamp Duty rates if you sell your previous main home within 3 years.

If we are buying a maisonette what additional costs can we anticipate? This is one tricky area where we cannot give you all the costs up front in our estimate. This is because leases vary in their requirements and also the costs charged by freeholder and management companies also vary. They can also be two parties to deal with i.e a landlords and managing agents who both charge. These charges therefore vary considerably with some leasehold purchases the fees can be as low as £10 but in extreme cases the costs charged can be around £500. This is why the government is considering regulating this area.

I have obtained probate for my fathers estate. Do you deal with sales by executors? Yes. As executors of the Estate you can sell and our legal costs remain the same as quoted for this type of Seller.
